General Terms and Conditions

Section 1: General Terms

"Our Agency", a real estate agency based in Paris, France, operates as an online platform facilitating the creation of accommodation listings by Owners and allowing Guests to reserve those accommodations. Owners or Guests can explore and discover suitable properties through the platform, accessible at https://www.erflat.com. Using this platform, you acknowledge and agree to adhere to the terms and conditions outlined in these Terms of Service (Terms), whether or not you register as a user of the Services.

Guest: Refers to an individual seeking to rent accommodations.

Owners: Denotes individuals or companies with the right to rent accommodations.

Listing: Encompasses photos, videos, and descriptions of accommodations posted on the Platform.

Rental Price: The amount that an Owner wishes to receive as monthly rent for the accommodation, also known as Owner price.

Monthly Rental Price: The cost an Owner sets for one month's rent of the accommodation.

Total Accommodation Price: The overall amount payable by the Guest for the entire duration of their stay.

Reservation: A document confirming that the accommodation is reserved for the Guest. To secure the reservation, the Guest must pay a Reservation fee to the Agency, which represents the agency fees.

Section 2: Our Offerings

The agency specializes in selling reservations for accommodations. These reservations assure the Guest that the specified accommodation will be available for them upon their arrival.

Section 3: Pricing & Reservation Procedure (LONG TERM RENTALS)

Guests are required to follow a detailed process when seeking reservations for accommodations, with the monthly rental price and minimum rental period specified on the detailed and booking pages. The monthly rental price may vary for different rental periods, typically decreasing with longer rental durations.

The reservation process unfolds as follows:

  1. Guest Request:

    The Guest initiates the reservation process by sending a request via the booking page.

  2. Agency Review:

    The Agency Manager reviews the reservation, ensuring it meets criteria such as a rental period exceeding one month, not falling below the minimum rental period, and contacts the Owner to confirm availability, price, and duration.

  3. Confirmation and Contract:

    Upon acceptance by the Owner, the Guest receives the reservation and agency contract. The Guest must fill in the contract, accept the Terms and Conditions, and pay the Reservation fee via a secure credit card transaction on the BRED bank's fully secured page.

  4. Reservation Fee Calculation:

    The Reservation fee is calculated based on the rental period:

    • Rent period of one month: 30% of the Rental price.
    • Rent period from one to three months: 50% of Monthly rental price.
    • Rent period from three to six months: 75% of Monthly rental price.
    • Rent period from six to nine months: 100% of Monthly rental price.
    • Rent period from nine to twelve months: 10% of Rental price.
  5. Lease Agreement:

    If the reservation request type, justification dossier, and rental period are accepted, the agent proposes a lease agreement tailored to the purpose of the stay. If not accepted, the Manager provides explanations for rejecting the reservation.

  6. Payment Confirmation:

    Upon payment of the Reservation fee, the Guest immediately receives the Reservation confirmation document and instructions for arriving at the accommodation and check-in. The Owner receives the signed Lease Agreement and signs it first, while the Guest gets the signed lease agreement from the Owner along with instructions for paying the Rental Prepayment.

  7. Rental Prepayment:

    The Rental Prepayment is due within one week and no later than the arrival at the accommodation.

  8. Reservation Limitations:

    • Reservations made more than one year prior to arrival are not accepted.
    • Reservations for periods less than one month are not accepted.
    • Reservations for periods exceeding one year are not accepted.
    • Reservations from tourists are not accepted.
    • The maximum transaction amount is limited to 10,000 EUR. Guests cannot purchase reservations exceeding this amount.

Section 5: Agreement Types Based on Stay Duration

The agency offers various agreements tailored to the duration of the stay:

  1. Mobility Contract:

    Suitable for stays ranging from one to 10 months.

  2. Student Contract:

    Specifically designed for a 9-month duration.

  3. One-Year Lease Agreement:

    Providing a comprehensive arrangement for a 12-month stay.

Section 6: Agency Responsibilities

The agency is committed to:

  • Providing the Owner with a collaborative platform for interacting with Guests, featuring a "My Account" module for setting Owner prices and adjusting accommodation availability;
  • Ensuring the ongoing availability and functionality of the Platform.

Section 7: Owner Responsibilities

Owners are expected to:

  • Respond to all inquiries and questions from Guests;
  • Take responsibility for all their accommodation listings;
  • Conduct the check-in and check-out processes for Guests;
  • Provide additional instructions to Guests on how to pay the Rental price after a reservation is confirmed, including sharing banking details;
  • Refrain from submitting listings with false or misleading price information or prices that they do not intend to honor;
  • Abstain from distributing Platform content;
  • Avoid circumventing any technological measures implemented by the Agency;
  • Refrain from interfering with or causing damage to the Platform, including the use of viruses, cancel bots, Trojan horses, harmful code, or similar methods.

Section 8: Insurance

Insurance is mandatory for real estate in France. For Mobility contracts, we recommend subscribing to insurance through garantme.com. For One-year lease agreements, we suggest AXA insurance through our partners.

Section 9: Disputes

The responsibility for leaving the accommodation in its original condition lies with the Guest. The Agency does not assume responsibility for dispute resolutions between the Owner and Guest. Any disputes should be resolved directly between the Owner and Guest. Before making a payment, the Guest will receive information about the Security Deposit, which may be required for the applicable accommodation. The Security Deposit is refunded during check-out if the accommodation is undamaged. In the event of a claim by the Owner with evidence of damage, the Guest agrees to cover the cost of replacing damaged items. If no claim is made, the Security Deposit is returned within 60 days, deducting any repair fees.

Section 10: Cancellation Policy

If the Guest cancels the booking, the Reservation fee is forfeited. If the Owner cancels, they must offer alternative properties for rent to the Guest. If not suitable, the Owner informs the Agency for a full refund of the Reservation fee to the Guest (100% refund). The Owner should also refund the Rental Price if paid. In such cases, the Agency may decrease the Owner's rank (reputation) on the Platform. If the Guest wishes to extend their stay, they must arrange this with the Owner and pay additional Agency fees for modifications, calculated proportionally to the initial payment.

Section 11: Check-in/Arrival

Normal check-in time:
13:00 – 18:00, without additional fees (except holidays and weekends).

Late check-in:
Should be discussed in advance, and the Owner may charge extra fees. Different accommodations may have distinct check-in rules; detailed information is available on the apartment's detailed page.

Section 12: Check-out/Departure

Normal departure time:
08:00 – 10:00, without additional fees (except holidays and weekends). Different accommodations may have different check-out rules; detailed information is available on the accommodation's detailed page.
